1. Introduction

These Website Standard Terms and Conditions govern your use of the Gengen website. These Terms apply fully to your use of Gengen. By using Gengen, you agree to accept all terms and conditions written here. If you disagree with any of these Terms, you must not use Gengen.
Minors or people below 18 years old are not allowed to use Gengen.

2. Intellectual Property Rights

Other than the content you own, Gengen Pte Ltd and/or its licensors own all the intellectual property rights and materials contained on Gengen.
You are granted a limited license only for the purpose of viewing the material contained on Gengen.

3. Restrictions

You are specifically restricted from all of the following

• Enabling or allowing others to use Gengen with your login credentials;
• Selling, sublicensing, or otherwise commercializing any Gengen material;
• Publicly performing or showing any Gengen material;
• Using Gengen in any way that is or may be damaging to Gengen;
• Using Gengen in any way that impacts user access to Gengen;
• Using Gengen contrary to applicable laws and regulations, or in any way cause harm to Gengen, or to any person or business entity;
• Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to Gengen;
• Using Gengen to engage in any advertising or marketing.

Certain areas of Gengen may be restricted from access, and Gengen Pte Ltd reserves the right to further restrict your access to any areas at its sole discretion. Any user ID and password you have for Gengen are confidential, and you must maintain their confidentiality.

4. User Content

In these Terms, "Your Content" shall mean any audio, video, text, images, or other material you choose to display on Gengen.
By adding Your Content publicly (on your pages or published projects) to your website hosted by Gengen, you grant Gengen Pte Ltd the right to reproduce, adapt, and display Your Content in advertising and marketing materials. This does not apply to content not publicly visible (e.g., drafts or password-protected projects).
Your Content must not contain any material that violates any laws or regulations, infringes upon third-party rights or privacy, or is contrary to relevant standards or codes, including generally accepted community standards. If there is suspicion that Your Content violates these Terms, Gengen Pte Ltd reserves the right to ban you from further use of Gengen. Additionally, Your Content may be removed without notice, and any subscription fees paid for it will not be refunded.
For clarity, we use these rights to immediately delete sites used for phishing, scams, escort services, pornography, etc.

5. Third-Party Platform Import Tools

Gengen may provide tools that allow you to import data from third-party platforms. These tools are offered for your optional use, and you are solely responsible for how you use these tools.

• You are responsible for ensuring your use of these tools complies with the terms and conditions of the third-party platforms.
• Gengen does not actively collect or access data from third-party platforms; the data import process is initiated and executed by you.
• Gengen disclaims any liability arising from the use of these import tools, including any violations of third-party platform agreements.
• You may not use these tools for any form of data scraping or data harvesting, and any actions that violate third-party platform terms are solely your responsibility.

Please read the relevant platform terms to ensure compliance before using the import tools.

6. No warranties

Gengen is provided "as is," with all faults, and Gengen Pte Ltd makes no representations or warranties, of any kind, related to Gengen or the materials contained on Gengen. Nothing on Gengen should be interpreted as advising you.

7. Limitation of liability

In no event shall Gengen Pte Ltd, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of Gengen, whether such liability is under contract. Gengen Pte Ltd, including its officers, directors, and employees, shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of Gengen.

8. Indemnification

You hereby indemnify to the fullest extent Gengen Pte Ltd from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these Terms.

9. Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

10. Variation of Terms

Gengen Pte Ltd is permitted to revise these Terms at any time as it sees fit, and by using Gengen, you are expected to review these Terms regularly.

11. Assignment

Gengen Pte Ltd is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

12. Entire Agreement

These Terms constitute the entire agreement between Gengen Pte Ltd and you in relation to your use of Gengen, and supersede all prior agreements and understandings.

13. Governing Law & Jurisdiction

These Terms and Conditions, and your use of this website, and any dispute or claim arising from or in connection with these matters, shall be governed by and interpreted in accordance with the laws of Singapore. You agree to submit to the exclusive jurisdiction of the courts of Singapore.
In case of a dispute, both parties agree to first attempt to resolve the issue through negotiation or mediation. If mediation fails, the dispute shall be submitted to the courts of Singapore.
